Under Vehicle Code Section 21200, a person riding a bicycle on a public roadway holds all the rights of a motor vehicle driver, along with most of the same duties. A motorist who crowds, cuts off, or turns across a lawfully riding cyclist has broken the same rules of the road that govern collisions between cars.

California’s Three Feet for Safety Act, Vehicle Code Section 21760, forbids a driver from passing a bicycle traveling in the same direction with less than three feet of clearance. When a sideswipe or a forced-off-the-road wreck follows an illegal close pass, that violation becomes powerful proof of negligence.

Adult riders are not required by statute to wear a helmet. Vehicle Code Section 21212 imposes that duty only on riders under 18.
